Agreement to Terms

By accessing www.hrmtlogistix.com or using any Hermetic Logistix service, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

These Terms constitute a legally binding agreement between you and Hermetic Logistix, LLC, a Georgia limited liability company ("Hermetic Logistix," "we," "us," or "our").

Services Description

Hermetic Logistix provides on-demand and scheduled medical courier services in the Atlanta metropolitan area, including but not limited to:

• Laboratory specimen transport (blood, urine, tissue, swabs)
• Pharmaceutical delivery (prescription medications, controlled substances, vaccines)
• Biologic and cryogenic transport
• Medical equipment logistics

Service availability, pricing, and geographic coverage are subject to change. We reserve the right to refuse service at our sole discretion.

Booking & Payment

Flat-rate bookings

Flat-rate bookings made through our website are charged at the time of booking via Stripe. Prices displayed are final and inclusive of all standard fees (dispatch, fuel surcharge). Payment must be received before courier dispatch.

Custom-quoted services

Quote-based services are subject to separate written agreements. No obligation is created by submitting a quote request until a written agreement is executed by both parties.

Refund policy

Cancellations made before courier dispatch are eligible for a full refund. Once a courier has been dispatched (typically within 15 minutes of booking confirmation), no refund will be issued. Disputes related to service quality should be directed to dispatch@hrmtlogistix.com within 48 hours of delivery.

Client Obligations

You agree to:

• Provide accurate pickup and delivery addresses and contact information
• Ensure pickup personnel are available and accessible at the scheduled time
• Package specimens and materials in accordance with applicable regulations (IATA, DOT, CDC guidelines) unless otherwise agreed in writing
• Not ship materials that are prohibited by law or that you do not have legal authority to transfer
• Ensure that receiving personnel are authorized to accept the delivery
• Notify us of any special handling, hazardous materials classifications, or regulatory requirements at the time of booking

Limitation of Liability

Hermetic Logistix's liability for any single delivery is limited to the lesser of: (a) the declared value of the shipment, (b) the fee paid for that specific delivery, or (c) $5,000 USD, unless a higher declared value has been agreed in writing and an additional insurance fee has been paid.

We are not liable for:

• Delays caused by traffic, weather, road closures, or other circumstances beyond our reasonable control
• Damage to improperly packaged materials
• Losses arising from inaccurate address or contact information provided by the client
• Consequential, incidental, or indirect damages of any kind
• Losses due to the inherent nature or pre-existing condition of the materials shipped

In no event shall Hermetic Logistix's total liability exceed the total fees paid by you in the twelve (12) months preceding the claim.

HIPAA Compliance

For clients who are HIPAA Covered Entities, Hermetic Logistix will enter into a Business Associate Agreement (BAA) upon written request. We handle Protected Health Information (PHI) solely as directed by the Covered Entity and in accordance with our HIPAA compliance program. Please contact compliance@hrmtlogistix.com to arrange a BAA.

Prohibited Uses

You may not use our services to transport:

• Any materials whose transport you are not legally authorized to arrange
• Controlled substances without proper DEA authorization
• Biological agents classified as Select Agents under federal law
• Weapons, explosives, or hazardous materials not disclosed at booking
• Human remains or organs outside of a specific written service agreement

Indemnification

You agree to indemnify and hold harmless Hermetic Logistix and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of our services; (b) your violation of these Terms; (c) improper packaging of materials; or (d) your violation of any applicable law or third-party right.

Governing Law & Disputes

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to personal jurisdiction there.

Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on our website. Continued use of our services after such changes constitutes acceptance of the updated Terms.
